“Dog Bite” Riders

Broadway Joe Namath may be among those property owners in need of a “dog bite” rider. 
 
The former New York Jets quarterback and football legend recently learned that his yellow Labrador retriever “Leo” was declared “dangerous” by a special magistrate in Palm Beach County, Florida, after Leo allegedly bite three people during a two-year span at his home in Tequesta, Florida. 
 
Whether or not the pooch in question has or has not bitten an individual in the past, many insureds assume that they have they are protected in the event that their dogs bite an individual when the truth of the matter is that they may not.
 
While it is true that the typical homeowners’ policy has historically automatically afforded coverage for injuries associated with a dog bite, more and more policies now specifically exclude this coverage. Thus, in order to be protected in the event that “Fido” bites a visitor or passer-by, the insured must purchase a special insurance rider or option. 
 
Because property insurance policies no longer automatically afford liability insurance protection for dog bites, insurance agents may have the potential for earnings opportunities by offering this rider or option to their clients.
 
Accordingly, it is recommended that insurance agents first determine whether their clients own dogs. If so, the next question to be considered is whether liability coverage for dog bites is specifically excluded from their property insurance coverage. If the answer to this second question is “yes,” the insurance agent should suggest that the insured purchase a rider affording coverage in the event of a loss.
 
Property owners who purchase insurance for property which is leased to others may also be in need of a rider if their tenants own dogs. 
 
Some landlords are unaware that they might be held liable for the actions of their tenants’ dogs. In general, however, if the landlord allows the tenant to keep a dog on the leased property and that dog then bites an individual on the landlord’s property, the property owner may be held liable for injuries associated with the attack. 
 
In Florida for instance, the courts have determined that a landlord may be held liable for the actions of the tenant’s dog, including in the jurisdiction where Namath resides. See NY Tran v. Bancroft, 648 So.2d 314 (Fla. 4th DCA 1995). 
 
In light of the fact that dog bite coverage is no longer automatically included in property insurance policies, it is recommended that insurance agents be proactive and determine whether their clients’ have a need for this coverage.
