As reported in the New York Times , the average complication rate fell to 7% from 11% after surgeons and their surgical teams were required to use simple checklists. The death rate fell even more - by almost 50%.
It’s surprising, considering all the technology, intelligence, training and education of a typical surgical team, that something as simple as a checklist would make such a difference.
Checklists for your business and your clients
What about checklists in our businesses? Many of us routinely use checklists for unimportant things, like buying groceries or running errands, but when it comes to the really important stuff, like making sure we’ve told our clients about flood insurance, the value of an umbrella or Employment Practices Liability Insurance, we often don’t even think about checklists. After all, we might think, we and our staffs deal with this every day, and a checklist would just slow us down. And where would we keep the checklist? Do we need a checklist to remind us to check the checklist?
But the value of a good checklist is undeniable. Not only can it help us remember important things that might have been overlooked, but the physical process of completing and then filing a checklist is actually a business process that may be admissible as evidence in a court proceeding if a client makes a claim that he or she had an uninsured loss that should have been covered. “If only I had known about this coverage….!”
The evidence that helps you defend yourself is right there in the file. (And besides, they are good for both the younger staff members who need some guidance and the seasoned professionals who are so busy that they might miss a few things.)
A word of caution; once you commit to using checklists, not having them in files can work against you in an E&O situation. So remember that using them effectively requires commitment.
Creating checklists you can use
At SafelyFiled we created checklists for our members so they could make sure they collected all the important documents in their lives. It wasn’t too difficult, but it did involve the whole staff. I created the first version and then the staff added to it. Fortunately, the staff was gentle with me and was not too critical about all the items I missed. But they did have a good time showing me up. When we all couldn’t think of anything else, we organized them so they made logical sense for the person using them and then published them. And when somebody else had a suggestion, we revised and republished.
We didn’t do this in a vacuum. We looked at other checklists and saw that some were too short and some were so long and burdensome that they might never be used. So, I suggest that you consider this when creating your own checklists. Too long and they are ignored. Too short and they’re useless.
Use them
Make using the checklists a part of your performance evaluations (even for yourself). If they’re not in the file, ask why. There might be a legitimate excuse. And though they might seem too stiff for some of your clients, you don’t have to announce you are running the client through a checklist. Good checklist questions can be woven into a conversation, with you or your staff making notations on what you mentioned without the client ever feeling like he or she isn’t special. Besides, checking a few boxes on a checklist is easier than extensive client notes.
