Actuarial Implications Regarding Self-Insured Employers for Workers’ Compensation

The Basics:
Bill 863 makes many changes to California’s workers’ compensation system. These changes include an increase in permanent disability benefits to injured workers, the creation of an independent medical panel to review injuries, and provisions to create cost-saving efficiencies. Some elements of the bill took effect on January 1, 2013, but not all of its provisions will kick-in right away; they will fully come into effect by early 2014.
The bill prevents “professional employer organizations,” temporary agencies, and employee leasing organizations from being self-insured, as well as stopping an employer who has been illegally uninsured from becoming self-insured unless the employer receives approval from the Self-Insurers’ Security Fund.
Self-insured public entities’ annual reporting requirements have been increased, and the Commission on Health and Safety and Workers' Compensation is now required to perform a study of the self-insured public entity program and make preliminary recommendations to improve the program by October 1, 2013.
California Department of Industrial Relations (DIR) Director Christine Baker summed the bill up by saying, “These reforms are engineered to reduce unnecessary costs while redirecting some of the savings to increase benefits for disabled workers.”
New Requirements for Self-Insurers:
Self-insured employers have always been required to pay deposits to help ensure that their workers’ compensation liabilities will be covered, but SB 863 changes the method of calculating the deposit amount, basing it now on an annual actuarial report based on data evaluated as of December 31 of the previous year.
This new actuarial study will be due every year, starting May 1, 2013, and must be created by a “qualified” third-party actuary who is a Fellow of the Casualty Actuarial Society (FCAS), a Member of the American Academy of Actuaries (MAAA), or a member of the Society of Actuaries (SOA) qualified to sign a statement of actuarial opinion on loss reserves.
The results of these actuarial reports will be used to establish the appropriate security deposit for each self insured, or the basis for contributions to the Alternative Security Program. This differs from the previous method employed since the 1970’s, when a state regulator established the security deposit each year for the self-insured by utilizing the self-insured’s case reserves times a multiplier as the primary basis for calculation.
Next Steps:
This new requirement will put pressure on self-insured employers who have never had an actuarial study commissioned. They will only have a short time to gather any and all necessary data, such as historical claims, insurance program summaries and payroll information, needed to complete the study.
It will be critical for these types of firms, and firms who only have an in-house actuary, to get an experienced third-party actuary to perform this annual study, because the report can be rejected by the Office of Self Insurance Plans (OSIP) after submission, forcing the firm to have the report done again, most likely by an alternate vendor.
