Arbitration Fairness Act Would Eliminate Forced Arbitration in Employment, Consumer and Civil Rights

In May 2011, U.S. Sens. Al Franken (D-Minn.) and Richard Blumenthal (D-Conn.) and U.S. Rep. Hank Johnson (D-Ga) introduced the Arbitration Fairness Act (the "Act"), which seeks to eliminate forced arbitration clauses in employment, consumer and civil rights cases, but would allow consumers and workers to elect arbitration after a dispute occurs.
Overview
Versions of the Act have been introduced in the past; however, this version was introduced as a direct response to the U.S. Supreme Court's April 2011 ruling in AT&T v. Concepcion, which held that the Federal Arbitration Act (FAA) preempted California's "Discover Bank Rule" and that an arbitration agreement precluding class arbitration is valid. California's Discover Bank Rule, named for 2005 State Supreme Court Decision, stated that class action waivers in consumer contracts of adhesion were unconscionable in cases where a party with superior bargaining power was alleged to have "cheat[ed] large numbers of consumers out of small sums of money."
Background
Concepcion involved a class action suit that alleged that AT&T had engaged in false advertising and fraud by charging sales tax on "free" phones. The cellular telephone contract between the purchasers and AT&T provided for arbitration of all disputes but required that claims be brought in the parties' "individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding."
A California district court denied a motion to compel arbitration, and the U.S. Court of Appeals for the 9th Circuit affirmed. The U.S. Supreme Court reversed the decision, holding that the FAA preempts California's Discover Bank Rule because the latter is an obstacle to the accomplishment and execution of the full purposes and objectives of Congress, as evidenced by the FAA.
The Legislation In a statement announcing his re-introduction of the Act, Sen. Franken said, "I've introduced the Arbitration Fairness Act to ensure that workers and consumers have the right to choose arbitration over litigation, instead of being forced into it [arbitration] by corporations." The Act is supported by advocacy groups for consumers and employees.
Conclusion
Some commentators note that this bill is unlikely to be approved by both houses of Congress in the current political environment. Wilson Elser will continue to monitor and report on the status of the Arbitration Fairness Act.
