The issue of insuring ATVAca,!a,,cs, go-karts, and other similar motorized vehicles (Aca,!A"low-powered vehiclesAca,!?) falls under the jurisdiction of the states, but in general, it is possible to insure low-powered vehicles for drivers too young to be licensed (Aca,!A"junior driversAca,!?). Most large national insurance companies allow junior drivers to be listed as additional insureds on policies containing low-powered vehicles. The option of listing a junior driver as an additional insured may depend on the junior driverAca,!a,,cs age because some insurance companies impose minimum age requirements for the junior drivers. For example, an insurer may allow children between the ages of ten and sixteen to be placed as additional insureds on a collision policy for low-powered vehicles, while automatically excluding children under ten years of age from being additional insureds. Other insurers, however, do not impose minimum age requirements for additional insureds of low-powered vehicles, assuming of course that the primary policyholder is at least eighteen years old.
Despite the willingness of insurers to provide coverage to junior drivers nationwide, it is important to determine your own stateAca,!a,,cs laws regarding low-powered vehicles with respect to both of the following: (1) minimum age requirements to operate low-powered vehicles; and (2) mandatory insurance coverage for low-powered vehicles being operated on public lands. Certain states, such as Pennsylvania, prohibit drivers under the age of ten from operating low-powered vehicles on public lands. In New York, drivers between ages ten and fifteen are permitted to operate low-powered vehicles on public lands with adult supervision, or without adult supervision if such use is permitted and the driver has completed an ATV safety-training course. Almost every state requires drivers of low-powered vehicles, regardless of age, to carry liability insurance if they are operating such vehicles on public lands.
While restrictions often apply to junior drivers operating low-powered vehicles, the mere ability of junior drivers to operate these vehicles on public lands raises concerns over insurability. As the number and variety of low-powered vehicles continues to increase, it is important to keep abreast of the rules and regulations regarding these vehiclesAca,!a,,c insurability. For those who plan on allowing junior drivers to operate low-powered vehicles, it is particularly valuable to make sure that the junior drivers can be added as additional insureds so as to be covered in the event of a collision. If the junior drivers cannot be added to an existing collision policy as additional insured, it is important for the junior drivers to avoid operating the low-powered vehicles on public lands.
