And, now, before you is a charge of discrimination for some reason you don’t understand and you don’t believe you did anything wrong. You may not have done anything so what do you do?
If you had Employment Practices Liability Insurance (EPLI) you would have:
1. Called your insurance provided lawyer prior to taking any termination action.
2. Should a claim be filed, you would call your insurance provided lawyer again and advise the lawyer of the charge before you and turn the charge over to them.
Business owners who want to survive in today’s economy need to take a serious look at the whether or not their company’s culture and/or management style invites a lawsuit from an employee. In the current economic environment with escalating unemployment, employees placed in the unfortunate position of being layed off or terminated are looking for ways to survive. One way is to claim that you were discriminated against or the employer denied you a right and then to file an employment practices lawsuit. The frightening reality is that even potential employees can sue your business!
All firms are susceptible and vulnerable to falling into the law suit trap. All it takes is one phone call claiming allegations from discrimination to mistreatment, or wrongful termination or failure to hire. You may think that perhaps a disgruntled employee who is terminated might proceed to seek vindication through a legal claim, but you don’t expect that the quiet current employee would take such measures. Even when affirmative defenses are in place to protect an organization, it does not guarantee that there will be no legal allegations of wrong doing.
Allegations can start from the pre-hiring process to current employment and even after years of separation. It is no secret that cases against employers are on the rise with no end in site. Worst yet, it is no laughing matter when a simple joke in the lunch room can be the cause of a legal battle in court costing companies thousands of dollars in legal defense. Companies who take necessary precautions and implement affirmative defense systems are to be commended. However, if an employee, customer, or even a vendor decides to accuse a company of wrong doing, even if the claim is fraudulent with no substantial backing, the defense alone can cost the company valuable time and thousands of dollars.
According to Jeffrey Klenk, as stated in the June 26 court ruling on changes of workplace sexual harassment landscape, an affirmative defense must show two things. First, it must show that the employer exercised reasonable care to prevent and promptly correct any sexually harassing behavior; second, it must show that the plaintiff employee unreasonably failed to take advantage of any preventive or corrective opportunities provided by the employer or to avoid harm otherwise. Klenk also stated that no longer in these cases is the burden on the plaintiff employee to prove some responsibility on behalf of the company for the harassment; the burden is clearly on the employer to prove it has an affirmative defense.
Fortunately, a relatively new form of liability insurance called Employment Practices Liability Insurance (EPLI) is available to companies to cover the costs associated with these claims. EPLI protection covers sexual harassment, discrimination, wrongful termination, and other employment-related allegations. It may not prevent the lawsuits, but it could save the company from closing its doors because of the expensive defense-related costs.
As business leaders take proactive measures to increase sales and profits, the need for protection grows even more. Good employers with no intentions of wrong doing are finding themselves in court, losing valuable time and money. Taking the proper steps to avoid major losses is not a luxury but rather a measure of security for the well-being of the company as a whole.
