OSHA's HazCom Rule and Personal Injury Suits

Last year, the Occupational Safety & Health Administration (OSHA) published a rule that modified its Hazard Communication (HazCom) requirements governing how chemical manufacturers, employers, and other organizations convey hazard information to employees. Previously, companies had some discretion over the appearance and wording of these labels. OSHA formulated these amendments to conform to the United Nation’s Globally Harmonized System of Classification and Labelling of Chemicals (GHS) and create a standardized approach regarding this issue because companies often operate in various countries with different laws. However, a D.C. Circuit panel in American Tort Reform Association v. OSHA recently questioned how this rule impacts common law tort suits in the United States.
HazCom was originally implemented in 1983 and requires chemical manufactures to determine if their products pose health risks to employees. If so, these risks must be communicated to their employees through the use of warning labels and safety data sheets. Furthermore, employers are obligated to develop programs to convey this information to employees. However, it was unclear if this regulation preempts state law failure to warn claims and the amendment attempted to alleviate this problem with the following language: “Nothing in this Act shall… enlarge or diminish or affect… the common law… with respect to injuries, disease, or death of employees.” It further states that it is intended to address comprehensively the issue of hazard communication and to “preempt any legislative or regulatory enactments of a state, or political subdivision of a state, pertaining to the subject.”
OSHA argued before the D.C. Circuit panel that the rule was strengthened to ensure it did not preempt common law claims. However, the American Tort Reform Association (ATRA) argued courts should treat the rule as a “regulation.” Hence, the underlying issue is whether compliance with these standards shields the manufacturer or employer from tort liability. If it is determined that the OSHA amendment serves as the “standard of care,” an employer-defendant’s non-compliance may constitute negligence per se .
